A Few QuestionsI, too, have seen this letter "Uphold the Charter" several times and believe the author did not rsearch his subject matter or understand the process. 1. What is the Article/Section Number in the Clay County Charter that says it is the job of the county attorney to uphold the charter? I've been unable to find it. 2. Who wrote the mysterious letter to the Supervisor of Elections stating the proposed amendment did not meet he requirements of the charter? Was this person an attorney? 3. Do you have a copy of this letter? I'l like to see it as it should be public record. According to the Division of Elections, the Supervisor of Elections is responsible for what is put on the ballot. However, if what she put there is what the BCC sent, I do not believe it was her job the determine whether or not it met the chartrer requirements. Nor do I think she had the power to refuse or change what she was sent by the BCC. As for the county attorney, I agree with him on this one. He serves at the pleasure of the BCC and his only job is to provide legal services to BCC and other county, boards, agencies as specified by county ordinances. Anytime there is litigation, you wait for the court to rule before issuing any statement.

I understand your optimistic outlook, Marsha, in hoping that Chambliss is nothing like Kirkman. As I recall, he was handpicked by Kirkman. That alone tells me he can not be relied upon to do the right thing. I saw the letter at one time but don't recall where I got it. The letter was from Karen Lake to the SOE. It's possible it may even be in the archives here, unfortunately I just don't remember.
There were several faux paux by the SOE in the last year or so, two or three actions which were not the correct ones yet no one in goverment was held accountable, it was the citizens who lost out each time.
Do I believe Kirkman herself did something deliberately in each of these situations to acheive a goal, not necessarily. Do I believe that there are those that would use the office of SOE to attain a particular result or action and that there is someone on the inside manipulating these events..........I most certainly do. I think the integrity of the office has been compromised significantly. I hope that Chris Chambliss is not part of the same group and restores the publics trust.
It's my opinion that for the BCC or Scruby to do anything regarding the salary amendment other then implementing it would be in contempt of court.
